When the sale of a matrimonial home finally closes in Ontario, many separating spouses expect an immediate electronic transfer of their share into their personal bank account.

However, real estate law and family property rules require a structured, protective protocol to ensure neither partner's equity is compromised before final legal settlement.

1. What Happens to the Sale Money on Closing Day?

> Direct Answer: On closing day, the buyer's lawyer wires the purchase funds directly to the sellers' real estate closing lawyer. The lawyer first pays off the existing mortgage balance, clears property tax adjustments, discharges secured debts (such as a HELOC), and deducts closing legal fees. The remaining net proceeds are deposited directly into the lawyer's designated legal trust account.

2. Why Are Funds Frozen in Trust?

Real estate lawyers in Ontario operate under strict professional conduct guidelines enforced by the Law Society of Ontario (LSO).

When a property is a matrimonial home or involved in a separation:

1. Joint Direction Required: The closing lawyer cannot disburse a single dollar of net proceeds to either spouse without signed, identical written direction from both spouses (or their respective independent family law lawyers).
2. Protection Against Premature Splitting: If equal distribution occurred without an executed Separation Agreement, one party might lose leverage regarding other equalization issues (like pensions, savings, or business assets).
3. Interest-Bearing Accounts: If disputes delay distribution for several months, the closing lawyer can deposit the net proceeds into an interest-bearing trust account so the capital continues to accrue interest safely.

3. Can Partial Advances Be Released Early?

> Direct Answer: Yes. If both spouses agree in writing, their lawyers can direct the closing lawyer to disburse a partial interim advance from the trust accountโ€”for example, $50,000 to each partner to cover down payments on rental leases or bridge financing for new individual homes.

Any interim advance must be agreed upon by both parties and formalized through independent legal advice (ILA).

4. Purchasing Your Next Home: Managing the Gap

Separating partners frequently face a timing challenge: they need funds from the matrimonial home sale to complete the purchase of their next individual residence in Milton, Burlington, or Toronto.

To bridge this gap:

  • Bridge Financing: Lenders can arrange short-term bridge financing if your shared home has a firm, unconditional Agreement of Purchase and Sale in place.
  • Mutual Release of Deposit: If you need funds for a firm purchase, both spouses can instruct their closing lawyer to release a portion of the incoming sale deposit early to satisfy the closing requirements of the new property.
Coordinated Closing Dates: Schedule your purchase closing a few days after* the matrimonial home sale closes to give lawyers time to reconcile trust funds.

Summary Checklist for Closing Day

  • [ ] Confirm your real estate closing lawyer knows the property is a matrimonial home.
  • [ ] Work with your family law counsel to draft an agreed-upon Direction as to Funds prior to closing day.
  • [ ] Verify that your existing lender has provided an official mortgage payout statement.
  • [ ] If buying a replacement home, coordinate bridge financing early with your mortgage specialist.
